- ABOUT THESE TERMS
These Terms & Conditions govern access to and use of the Nirius Brands website and the process for enquiries, private sourcing, offers and purchases arranged between Nirius Brands and customers.
The website is operated by:

Nirius Brands is a luxury watch distributor offering new watches and private sourcing services.
The website does not operate an online checkout, shopping cart or online card-payment facility. A customer does not complete a purchase merely by browsing the website or submitting an enquiry.
- WEBSITE AND SALES MODEL
The Nirius Brands website operates as a product catalogue and enquiry platform.
Customers may browse watches, view product information, submit Product Enquiries, request Private Sourcing and contact Nirius Brands.
Purchases are concluded privately.
A typical transaction is: Website enquiry → communication with customer → written or telephone offer/confirmation → customer acceptance → Nirius Brands confirmation of the order → invoice/order documentation → bank transfer → dispatch.
Submitting an enquiry does not itself create a sales contract.
- ELIGIBILITY AND CUSTOMER STATUS
Nirius Brands sells to both:
- consumers acting outside their trade, business, craft or profession (B2C); and
- businesses, professionals and other commercial customers (B2B).
Where a provision applies differently to B2C and B2B transactions, the applicable section below will prevail.
- PRODUCT INFORMATION
All watches offered by Nirius Brands are represented as new, authentic and unused unless expressly stated otherwise in writing.
Product listings may include brand and model, reference number, specifications, images, included documentation, manufacturer warranty information and availability.
We take reasonable care to keep product information accurate and current. Availability may change and information may be updated before an order is confirmed.
Product images are intended to represent the corresponding watch. Minor differences in colour or appearance may occur because of photography, display settings or manufacturer imagery.
- AUTHENTICITY AND CONDITION
Nirius Brands sells new watches and does not offer pre-owned, second-hand or used watches through this website.
We represent watches supplied by us as authentic products.
Where manufacturer documentation, warranty cards or other accessories are supplied with a watch, the relevant items will be identified in the product information or private offer.
Nirius Brands is not to be understood as an authorised dealer, agent, representative or official partner of a particular watch manufacturer unless this is expressly stated by Nirius Brands in writing for that brand or transaction.
- PRICES
The website may display either:
PRICE
or
PRICE ON REQUEST
Where a numerical price is displayed, it is the stated sale price in EUR at the time shown on the website.
Where PRICE ON REQUEST is displayed, no public numerical price is shown and the customer must submit an enquiry to receive a private offer.
All sales remain subject to order confirmation by Nirius Brands.
Unless expressly stated otherwise in a written offer, the delivery charge is separate from the product price.
The standard delivery charge is EUR 70 per shipment.
Any taxes, duties, charges or other amounts required by law will be identified where applicable before the transaction is finalised.
- ENQUIRIES AND PRIVATE OFFERS
A Product Enquiry, Private Sourcing request or Contact submission is a request for communication and does not constitute a binding contract.
Nirius Brands may provide a written or telephone quotation or offer after reviewing the enquiry.
A sale is confirmed only after:
- the customer accepts the written offer or confirms the purchase by telephone; and
- Nirius Brands confirms the order.
The final commercial terms may be recorded in the relevant written offer, order confirmation and/or invoice.
Where there is a conflict between these general Terms and a specific written transaction document, the specific transaction document will prevail to the extent permitted by law.
- PAYMENT
Payment is arranged privately and is made exclusively by bank transfer.
Nirius Brands does not operate online card payments or a website checkout.
Payment may be made in full before dispatch. Where agreed in writing, Nirius Brands may accept an advance payment or deposit.
The applicable amount, payment deadline and bank details will be provided privately in the relevant invoice or payment instructions.
Customers should not make payment to bank details obtained from an unverified third party. Where bank details appear to have changed unexpectedly, customers should contact Nirius Brands using info@niriusbrands.com before making payment.
An order is not dispatched until the required payment has been received and verified, unless a different arrangement has been expressly agreed in writing.
- ORDER CANCELLATION BEFORE DISPATCH
Before an order has been dispatched, cancellation requests should be made as soon as possible by contacting Nirius Brands.
Whether an advance payment or deposit is refundable will depend on the specific agreement, applicable law and the circumstances of the cancellation.
Nothing in these Terms limits mandatory statutory rights.
- DELIVERY
Nirius Brands currently offers delivery only to destinations within the European Union.
We do not currently offer standard delivery through this website to the United Kingdom, Switzerland, the United States or destinations outside the European Union.
Delivery is made exclusively through DHL Express.
The standard delivery charge is EUR 70 per shipment unless a different amount is expressly stated in the written offer.
Watches are dispatched from Bulgaria.
The estimated delivery time will be communicated with the relevant order or delivery information after payment has been confirmed.
For eligible B2C sales where the seller arranges delivery, applicable consumer law determines responsibility for loss or damage before delivery.
Transport arranged by Nirius Brands is insured for the full declared value of the watch, subject to the applicable terms and conditions of the carrier and insurance arrangement.
- DELIVERY ADDRESS AND CUSTOMER RESPONSIBILITIES
The customer is responsible for providing a complete and accurate delivery address, telephone number and other information required by the carrier.
If delivery cannot be completed because the customer has supplied incorrect information, is unavailable, refuses delivery or fails to comply with reasonable carrier requirements, additional delivery or handling costs may apply where legally permissible.
Customers should inspect the package and watch promptly after delivery and notify Nirius Brands as soon as reasonably possible of any visible transport damage or discrepancy.
- RIGHT OF WITHDRAWAL — B2C
For eligible B2C distance contracts, consumers generally have a statutory right to withdraw within 14 days without giving a reason. For goods, the period normally begins when the consumer or a third party indicated by the consumer, other than the carrier, acquires physical possession of the goods.
To exercise the right of withdrawal, the consumer should contact:
info@niriusbrands.com
and clearly state that they wish to withdraw from the contract.
The consumer should provide sufficient information for Nirius Brands to identify the relevant order.
The consumer is responsible for the direct cost of returning the goods unless applicable law provides otherwise.
The returned watch must be sent to:
Kryptonite Style LTD Trading as Nirius Brands ul. Kolednitsa №2, floor 1 Ruse, Bulgaria, 7002
Unless applicable law provides otherwise, the watch should be returned complete, unused and unworn, together with its original box, documents, warranty card and other accessories supplied with the watch.
Consumers are responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, to the extent permitted by applicable law.
Refunds and refund timing will be handled in accordance with applicable consumer law after the withdrawal has been validly exercised and the relevant return conditions have been satisfied.
Certain statutory exceptions to the right of withdrawal may apply in specific circumstances. Any applicable exception will be explained before the relevant transaction where required by law.
Nothing in this section limits mandatory consumer rights.
- RETURNS
The returns procedure for an eligible B2C withdrawal is described above and is subject to applicable law.
A return is not the same as a warranty or legal conformity claim.
For a product that is defective or does not conform to the contract, customers should contact Nirius Brands so that the claim can be handled under the applicable legal guarantee rules.
B2B customers do not receive the statutory consumer withdrawal rights applicable to consumers solely because an order was arranged by distance communication.
Any B2B return, cancellation or refund rights will be governed by the specific transaction agreement and applicable commercial law.
- LEGAL GUARANTEE OF CONFORMITY — B2C
For B2C sales, mandatory consumer rights relating to legal conformity apply in addition to any manufacturer's commercial warranty.
EU rules provide consumers with a minimum two-year legal guarantee of conformity for new goods. Depending on applicable national law, additional or more favourable protections may apply.
Where a watch is defective, does not conform to the contract or does not correspond to the description, Nirius Brands will handle the claim in accordance with applicable legal guarantee rules.
Depending on the circumstances and applicable law, remedies may include repair, replacement, price reduction or reimbursement.
The legal guarantee is a statutory obligation and is not replaced or reduced by the manufacturer's commercial warranty.
- MANUFACTURER WARRANTY
Many watches supplied by Nirius Brands are covered by an international manufacturer's commercial warranty.
The warranty period varies by brand and model and may range from approximately 2 to 8 years, depending on the manufacturer and product.
Where applicable, the watch is supplied with the manufacturer's warranty card or certificate.
The manufacturer's commercial warranty is separate from, and does not replace or reduce, mandatory statutory consumer rights.
Warranty claims should be directed to Nirius Brands or to the relevant manufacturer service channel identified in the applicable warranty documentation, depending on the nature of the claim and the manufacturer's warranty terms.
Warranty coverage is subject to the manufacturer's applicable warranty terms and exclusions.
- WARRANTY EXCLUSIONS
The manufacturer's warranty may exclude matters such as damage caused by misuse, accidents, improper handling, unauthorised modification, external damage or other exclusions stated in the manufacturer's warranty documentation.
Nothing in this section limits statutory legal guarantee rights that cannot lawfully be excluded or reduced.
- B2B TRANSACTIONS
Customers purchasing in the course of a business or professional activity are treated as B2B customers where legally applicable.
B2B customers should provide accurate company details, VAT information where applicable and a valid business delivery address.
B2B customers do not benefit from consumer-only rights such as the statutory 14-day consumer withdrawal period unless a specific contractual or legal provision provides otherwise.
The rights and obligations of B2B parties may be further defined in the relevant offer, order confirmation, invoice or separate commercial agreement.
- BRAND NAMES AND INTELLECTUAL PROPERTY
All brand names, trademarks, logos, product names, photographs, text and other content appearing on the website belong to their respective owners or are used by Nirius Brands where authorised or otherwise permitted.
Nothing on the website grants a visitor a licence or right to use any trademark, logo, photograph or other protected material without the applicable owner's permission.
Nirius Brands and the Nirius Brands name are operated by Kryptonite Style LTD.
- WEBSITE CONTENT AND AVAILABILITY
We aim to keep the website accurate, secure and available, but we do not guarantee that the website will always be uninterrupted, error-free or available without temporary maintenance or technical interruption.
We may update, remove or change catalogue information, product availability, images, content or functionality where reasonably necessary.
A watch displayed on the website may become unavailable before an enquiry or order is confirmed.
- PRIVATE SOURCING
Private Sourcing allows customers to ask Nirius Brands to source a watch that is not currently displayed in the catalogue.
A sourcing request is not a guarantee that a particular watch can be obtained.
Any private sourcing quotation is subject to availability, authenticity checks, supplier conditions, price confirmation, delivery arrangements and final written or telephone confirmation of the transaction.
No sourcing agreement is binding until the applicable terms have been confirmed by Nirius Brands.
- FRAUD PREVENTION AND VERIFICATION
Because Nirius Brands deals in high-value goods, we may carry out reasonable identity, payment, fraud-prevention, sanctions, compliance or transaction checks where permitted or required by law.
We may request additional information or documentation where reasonably necessary before accepting or completing a transaction.
We may refuse or cancel a transaction where required by law or where we have reasonable grounds to suspect fraud, unlawful activity, payment abuse or other material risk.
- LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Subject to that restriction, Nirius Brands will not be responsible for indirect or consequential losses to the extent such liability may lawfully be excluded.
For consumers, mandatory statutory rights and remedies remain unaffected.
For B2B transactions, any agreed limitation of liability may also be contained in the specific commercial documentation applicable to the transaction.
- EVENTS OUTSIDE OUR CONTROL
Nirius Brands will not be responsible for delays or failure to perform caused by circumstances beyond its reasonable control, including major technical failures, carrier disruptions, natural disasters, government action, strikes, war, civil unrest, significant infrastructure failures or other force majeure events.
This clause does not remove mandatory consumer rights relating to refunds, cancellation or other statutory remedies.
- PRIVACY AND COOKIES
Personal data is processed in accordance with our Privacy Policy.
Cookie use is explained in our Cookie Policy.
By submitting information through the website, customers should ensure that the information provided is accurate and that they have the necessary authority to provide business information where applicable.
- CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our business, website, legal requirements or services.
The version published on the website at the relevant time will apply to future website use and, where incorporated into a transaction, to the extent permitted by applicable law.
A change to these Terms will not retroactively alter an already confirmed transaction unless required or permitted by law.
- APPLICABLE LAW
These Terms and the contractual relationship with Nirius Brands are intended to be governed by Bulgarian law, to the extent permitted by applicable law.
For B2B transactions, Bulgarian law will govern and disputes shall be submitted to the competent courts in Bulgaria, unless the parties have validly agreed otherwise in writing.
For B2C transactions, Bulgarian law may apply, but the choice of Bulgarian law does not deprive a consumer of protections that cannot legally be excluded and that apply to the consumer under mandatory consumer-protection rules of the consumer's country of residence, where applicable.
Any jurisdiction clause applicable to a B2C transaction shall be interpreted subject to mandatory rules governing consumer jurisdiction.
- DISPUTE RESOLUTION AND CONSUMER COMPLAINTS
Customers should first contact:
info@niriusbrands.com
We will make reasonable efforts to resolve complaints and transaction issues directly.
Consumers retain any rights available under applicable consumer protection and dispute-resolution law.
Nothing in these Terms prevents a consumer from exercising mandatory rights to bring proceedings before a competent court or from using an applicable official consumer complaint or alternative dispute-resolution mechanism.
- SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in full force to the extent permitted by law.
- ENTIRE AGREEMENT
These Terms, together with any applicable product information, written offer, order confirmation, invoice and other transaction-specific documentation, form the contractual framework applicable to the relevant transaction.
Where a specific written transaction document contains terms that expressly override these general Terms, the specific terms will apply to that transaction to the extent permitted by law.
