RETURNS & RIGHT OF WITHDRAWAL POLICY

1. SCOPE

This Returns & Right of Withdrawal Policy applies to consumer purchases of new watches from Kryptonite Style LTD, trading under the brand name Nirius Brands (“Nirius Brands”, “we”, “us”, or “our”).

Nirius Brands does not operate an online checkout. Watches are purchased through a private sales process following an enquiry, written or telephone communication, an offer, and confirmation of the order. Payment is made by bank transfer.

For business customers (B2B), returns and cancellations are governed by the individual commercial agreement or order confirmation and the applicable law. The statutory consumer right of withdrawal described below applies only where the customer qualifies as a consumer and the relevant consumer contract is a distance contract or another contract for which a right of withdrawal applies.

Nothing in this Policy limits any mandatory consumer rights provided by applicable law.

1. 14-DAY RIGHT OF WITHDRAWAL FOR ELIGIBLE CONSUMERS

Where a consumer contract is concluded at a distance and the statutory right of withdrawal applies, the consumer generally has the right to withdraw from the purchase within 14 calendar days without giving a reason.

For goods, the withdrawal period begins from the day the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods.

To exercise the right of withdrawal, the consumer must inform Nirius Brands of the decision to withdraw before the end of the applicable withdrawal period.

The consumer is not required to use a particular form. A clear statement identifying the order and communicating the decision to withdraw is sufficient.

1. HOW TO REQUEST A RETURN

Please contact us at info@niriusbrands.com and include:

• Full name
• Order or invoice number
• Date of delivery
• The watch being returned
• A clear statement that you wish to withdraw from the purchase
• Contact details for communicating about the return

We will provide the return instructions and confirm the applicable return procedure.

Do not send a watch back to us before contacting Nirius Brands and receiving return instructions.

1. RETURN CONDITION

For a change-of-mind return, the watch should be returned in the condition in which it was received.

We require, where reasonably applicable:

• The watch to be unused and unworn;
• The original box and packaging;
• All original accessories;
• All available manufacturer documentation;
• Warranty card or warranty documentation, where supplied;
• Any additional items supplied with the watch.

Customers should handle and inspect the watch only to the extent necessary to establish its nature, characteristics and functioning.

Where a consumer handles the goods beyond what is necessary for such inspection and this causes a reduction in their value, the consumer may be responsible for that diminished value to the extent permitted by applicable law.

These requirements do not remove or reduce any mandatory statutory rights of a consumer.

1. RETURN SHIPPING COSTS

For an eligible change-of-mind withdrawal, the consumer is responsible for the direct cost of returning the watch to Nirius Brands, unless applicable law requires otherwise.

The original shipment from Nirius Brands to the consumer is sent by DHL Express and is separately charged at a fixed rate of €70.

Where applicable law requires Nirius Brands to reimburse the consumer for the standard delivery cost paid for the original shipment, the applicable amount will be reimbursed in accordance with the law. A consumer is not entitled to reimbursement of any additional delivery cost resulting from choosing a more expensive delivery option where such a choice existed.

The consumer remains responsible for the cost and risk of returning the goods until they have been received by Nirius Brands, subject to any mandatory rights under applicable law.

Because watches are high-value goods, we strongly recommend using a tracked and fully insured service for any return.

1. RETURN ADDRESS

Unless Nirius Brands provides different written instructions for a particular order, eligible returns should be sent to:

Returns sent to another address without prior written confirmation may be delayed.

1. REFUNDS

After a valid withdrawal, Nirius Brands will reimburse the payments received from the consumer for the returned goods, subject to the consumer's statutory rights and any lawful deduction for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Where the law requires reimbursement of the original standard delivery charge, this will also be reimbursed in accordance with applicable law.

The refund will generally be made using the same payment method used for the original transaction, unless the parties expressly agree otherwise and the alternative method does not create additional costs for the consumer.

As payment for purchases is made by bank transfer, refunds will normally be made by bank transfer.

Nirius Brands may withhold reimbursement until we have received the returned goods or the consumer has supplied evidence that the goods have been sent back, whichever occurs first, where permitted by applicable law.

1. TIME LIMIT FOR RETURNING THE GOODS

After communicating a withdrawal decision, the consumer must send the goods back without undue delay and normally no later than 14 days from the day on which the withdrawal decision was communicated to Nirius Brands.

The deadline is met if the goods are dispatched before the end of that 14-day period.

1. DAMAGED, MISSING OR INCOMPLETE RETURNS

Returned watches should contain the complete set of items supplied with the original order.

If a watch is returned with missing components, missing documentation, damage, signs of wear, or other changes beyond what is necessary to inspect the goods, Nirius Brands may assess whether the consumer is responsible for a resulting reduction in value, subject to applicable law.

We will not use this provision to remove or reduce mandatory consumer rights.

1. FAULTY OR NON-CONFORMING WATCHES

The right of withdrawal is separate from the consumer's legal rights concerning defective or non-conforming goods.

If a watch is faulty, damaged, or does not conform to the sales contract, please contact us promptly at info@niriusbrands.com and describe the issue.

Consumers retain their mandatory legal rights regarding conformity and defects. Under EU consumer rules, consumer goods are generally covered by a minimum two-year legal guarantee of conformity, subject to the applicable national rules and legal conditions.

The legal guarantee is a responsibility of the seller and is separate from any manufacturer's commercial warranty.

The manufacturer's international warranty supplied with a watch may provide additional protection. Warranty periods vary by brand and may generally range from 2 to 8 years depending on the manufacturer and model.

Nothing in this Policy limits any mandatory legal guarantee or remedy available to a consumer.

1. B2B PURCHASES

The statutory 14-day consumer withdrawal right does not generally apply to purchases made by businesses acting in the course of their trade or profession.

B2B cancellations, returns, credits, and other after-sales arrangements are governed by the relevant commercial agreement, order confirmation, invoice, and applicable law.

Nirius Brands may agree specific B2B return or cancellation terms in writing on a case-by-case basis.

1. PRIVATE SOURCING AND SPECIAL ORDERS

Private Sourcing requests may involve a specific watch being sourced at the customer's request.

The applicable return and cancellation rights will depend on the final contract, the customer's legal status, the nature of the goods, and applicable mandatory law.

Nothing in this section is intended to exclude or restrict a consumer's mandatory statutory rights.

Where a specific legal exception to the right of withdrawal applies, Nirius Brands will inform the consumer before the relevant contract is concluded.

1. NO LIMITATION OF STATUTORY RIGHTS

This Policy is intended to explain the Nirius Brands return process and does not replace mandatory consumer protection law.

Where applicable law grants a consumer rights that are more favourable than the terms stated in this Policy, those mandatory rights will prevail.
